Welcome to CANIFORT.
The terms “we,” “us,” and “our” refer to CANIFORT. CANIFORT operates this store and website, including the related information, content, features, tools, products, and services offered to customers collectively referred to as the “Services.”
Our store is powered by Shopify, which provides the ecommerce platform that enables us to offer the Services.
These Terms of Service, together with any policies referenced in them, describe your rights and responsibilities when accessing or using the Services.
Please read these Terms carefully. They contain important information regarding your legal rights, warranties, limitations of liability, and other matters.
By visiting, interacting with, or using the Services, you agree to these Terms of Service and our Privacy Policy.
If you do not agree to these Terms or our Privacy Policy, you should not access or use the Services.
SECTION 1 – ACCESS AND ACCOUNTS
By agreeing to these Terms, you represent that you are at least the age of majority in your province, state, territory, or jurisdiction of residence.
You may permit a minor dependent to use the Services through a device that you own or manage only where permitted by applicable law and under your supervision.
To access certain Services or place an order, you may be required to provide information such as your name, email address, billing information, payment information, and shipping information.
You represent that all information you provide is accurate, current, and complete and that you are authorized to provide it.
You are responsible for protecting your account credentials and for activity conducted through your account. You may not sell, assign, transfer, or license your account to another person.

We make reasonable efforts to display and describe our products accurately.
Product colours and appearance may vary depending on your screen, device, lighting conditions, and display settings.
We do not guarantee that the appearance of a product on your screen will exactly match its appearance in person.
Product descriptions, availability, pricing, and specifications may be updated without notice.
We may discontinue a product or limit the quantity of products available to a person, household, geographic region, or jurisdiction, subject to applicable law.
Nothing in this section limits any mandatory right or warranty available under applicable consumer protection laws.
SECTION 3 – ORDERS, CHANGES, AND CANCELLATIONS
Submitting an order constitutes an offer to purchase products from CANIFORT.
We may accept, decline, limit, or cancel an order where permitted by applicable law, including in cases involving suspected fraud, pricing errors, product unavailability, payment problems, or quantities that appear intended for unauthorized resale.
An order is accepted when we confirm acceptance or begin processing it.
You may request a change or cancellation within 5 minutes after placing your order.
To submit a request, contact support@canifort.com immediately and include your order number.
After the five-minute period has passed, the order may enter processing and may no longer be changed or cancelled.
We cannot guarantee that a cancellation or modification request will be completed if the order has already entered processing.
If we decline or cancel an order after payment has been received, we will issue an appropriate refund to the original payment method.
Returns and refunds are governed by our Refund Policy.
Products purchased through the Services are intended for personal or household use unless we expressly agree otherwise.
SECTION 4 – PRICES, PROMOTIONS, AND BILLING
Prices, promotions, discounts, and product availability may change without notice.
The amount charged will be the amount shown at checkout and confirmed in your order confirmation.
Unless expressly stated otherwise, displayed product prices do not include shipping charges, customs duties, import fees, or applicable taxes.
Any additional charges collected by us will be disclosed before you complete payment.
Promotional offers may be governed by separate terms. If promotional terms conflict with these Terms, the promotional terms will apply to that promotion.
You agree to provide accurate and complete billing, payment, and account information.
You confirm that you are authorized to use the payment method submitted and that the payment information provided is accurate.
You agree to pay the total amount displayed at checkout, including any applicable shipping charges and taxes.
SECTION 5 – SHIPPING AND DELIVERY
Orders are processed and delivered according to our Shipping Policy.
Processing and delivery times are estimates and may be affected by carriers, customs procedures, weather, public holidays, incorrect address information, and circumstances outside our reasonable control.
Tracking information will be provided when available.
If an order is lost, materially delayed, damaged during delivery, or delivered incorrectly, contact us at support@canifort.com.
Available remedies will be determined according to our Shipping Policy and applicable consumer protection laws.
Nothing in these Terms transfers responsibility for a shipment to the customer earlier than permitted by applicable law.
SECTION 6 – INTELLECTUAL PROPERTY
The Services and their contents, including trademarks, brand names, logos, text, graphics, photographs, product images, videos, audio, website design, and arrangement of content, are owned by or licensed to CANIFORT and are protected by applicable Canadian and international intellectual property laws.
You may use the Services only for personal and lawful purposes.
Unless we provide prior written permission, you may not reproduce, copy, distribute, modify, publicly display, publish, transmit, sell, license, commercially exploit, or create derivative works from material contained in the Services.
Nothing in these Terms grants you ownership of or a licence to CANIFORT’s intellectual property except for the limited right to access and use the Services in accordance with these Terms.
CANIFORT’s names, logos, product names, designs, and slogans may be trademarks of CANIFORT or its licensors and may not be used without prior written permission.
Shopify’s trademarks belong to Shopify. Other trademarks appearing through the Services belong to their respective owners.
SECTION 7 – THIRD-PARTY TOOLS
The Services may provide access to tools, applications, integrations, or services operated by third parties.
We do not necessarily monitor or control third-party tools.
Third-party tools may be provided on an “as available” basis and may be governed by separate terms and privacy policies.
Your use of third-party tools is at your own discretion and risk. You should review the terms and policies applicable to those tools before using them.
We may introduce new tools, features, or resources in the future. Unless otherwise stated, those additions will form part of the Services and will be governed by these Terms.

We do not control and are not responsible for the content, accuracy, availability, privacy practices, security, or operation of third-party websites or services.

Questions or disputes involving a third party’s products or services should be directed to that third party.
SECTION 9 – RELATIONSHIP WITH SHOPIFY
CANIFORT uses Shopify to provide its ecommerce platform.
Purchases made through our store are transactions directly between you and CANIFORT.
Shopify is not the seller of CANIFORT products and is not responsible for fulfilling orders, providing customer support, or resolving disputes between CANIFORT and its customers, except to the extent Shopify separately provides a service directly to you.
SECTION 10 – PRIVACY
Personal information collected through the Services is handled according to our Privacy Policy.
Because Shopify hosts the Services, Shopify may collect and process personal information relating to your access to and use of the Services.
Information may also be processed by payment providers, shipping providers, fulfilment providers, analytics services, customer-support tools, and other service providers necessary to operate the store.

SECTION 11 – REVIEWS, FEEDBACK, AND SUBMISSIONS
If you voluntarily submit a review, photograph, video, suggestion, idea, comment, or other content to CANIFORT, collectively referred to as “Feedback,” you grant CANIFORT a non-exclusive, worldwide, royalty-free, transferable, and sublicensable licence to use, reproduce, adapt, publish, translate, distribute, and display that Feedback for lawful business purposes.
This licence allows us to operate, improve, and promote the Services and our products.
You retain any ownership rights you otherwise hold in your Feedback.
You represent that:
1. You created the Feedback or have permission to submit it.
2. The Feedback does not infringe another person’s intellectual property, privacy, personality, or other rights.
3. The Feedback is accurate and is not intentionally misleading.
4. You have disclosed any incentive or compensation connected with the Feedback where required.
5. The Feedback does not contain unlawful, defamatory, abusive, obscene, or malicious material.
We may monitor, reject, edit, or remove Feedback where permitted by applicable law.
We are not required to maintain Feedback in confidence, pay compensation for it, or respond to it unless we have agreed otherwise.
SECTION 12 – ERRORS AND INACCURACIES
The Services may occasionally contain typographical errors, inaccurate information, or omissions relating to product descriptions, pricing, discounts, promotions, shipping charges, delivery estimates, availability, or other matters.
We may correct errors and update information when reasonably necessary.
If an error materially affects an order that you already placed, we may contact you to explain the issue and, where permitted by law, offer an appropriate correction, alternative, or refund.
Nothing in this section permits us to disregard a completed consumer contract or applicable pricing and consumer protection laws.
SECTION 13 – PROHIBITED USES
You may use the Services only for lawful purposes.
You may not use the Services to:
1. Violate any applicable international, federal, provincial, state, territorial, or local law.
2. Infringe the intellectual property, privacy, or other rights of CANIFORT or another person.
3. Submit false, fraudulent, deceptive, or misleading information.
4. Harass, threaten, abuse, defame, intimidate, or harm another person.
5. Distribute malware, viruses, malicious code, or other harmful technology.
6. Collect or track personal information without authorization.
7. Send spam, phishing messages, unauthorized promotions, or similar solicitations.
8. Impersonate another person or falsely represent your identity or affiliation.
9. Interfere with the security, availability, operation, or functionality of the Services.
10. Bypass or attempt to circumvent access controls, security systems, rate limits, or other technical protections.
11. Reproduce, scrape, extract, resell, or commercially exploit the Services or their contents without authorization.
We may restrict or terminate access to the Services where we reasonably believe these Terms have been violated.
SECTION 14 – TERMINATION
You may stop using the Services at any time.
We may suspend or terminate access to some or all of the Services where reasonably necessary, including when a user violates these Terms, engages in fraudulent or unlawful conduct, interferes with the Services, or creates a security risk.
Termination does not eliminate obligations or liabilities that arose before termination.
Sections that by their nature should continue after termination will remain in effect, including provisions concerning intellectual property, Feedback, disclaimers, limitations of liability, indemnification, governing law, and outstanding payment obligations.
SECTION 15 – WARRANTIES AND DISCLAIMERS
We aim to provide accurate and useful information through the Services, but information of a general nature may not always be complete, current, or suitable for every individual circumstance.
Except where expressly stated by CANIFORT or required by law, the Services are provided on an “as available” basis.
To the extent permitted by applicable law, we do not guarantee that access to the website will always be uninterrupted, timely, secure, or error-free.
Product results may vary depending on the animal, environment, use, and other circumstances.
Nothing in these Terms excludes, restricts, or limits any legal warranty, remedy, or consumer right that cannot lawfully be excluded or limited.
Products sold to consumers remain subject to all mandatory warranties and protections provided by applicable law.
SECTION 16 – LIMITATION OF LIABILITY
To the maximum extent permitted by applicable law, CANIFORT will not be liable for indirect, incidental, special, punitive, or consequential damages arising from use of the Services or products purchased through the Services.
This may include lost profits, lost revenue, loss of data, replacement costs, or similar losses, where such exclusions are legally permitted.
Our liability will not be excluded or limited where doing so is prohibited by law.
Nothing in these Terms excludes liability for fraud, intentional misconduct, gross fault, personal injury, violation of mandatory consumer rights, or any other liability that cannot legally be excluded or limited.
SECTION 17 – INDEMNIFICATION
To the extent permitted by applicable law, you agree to indemnify and hold CANIFORT and its representatives harmless from third-party claims, liabilities, losses, or reasonable legal costs arising directly from:
1. Your material breach of these Terms.
2. Your unlawful use of the Services.
3. Your infringement of another person’s rights.
4. Content or Feedback that you submit in violation of these Terms.
This section does not require a consumer to indemnify CANIFORT for CANIFORT’s own fault, negligence, unlawful conduct, breach of contract, or violation of applicable law.
SECTION 18 – SEVERABILITY
If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision will be enforced to the maximum extent permitted by law or severed where necessary.
The remaining provisions will continue in effect.
SECTION 19 – WAIVER AND ENTIRE AGREEMENT
Our failure to enforce a provision of these Terms does not constitute a waiver of that provision or any other right.
These Terms, together with the policies and rules incorporated into them, constitute the agreement governing your use of the Services.
They replace prior communications or understandings concerning the same subject matter, except where a separate written agreement expressly applies.
Nothing in this section limits representations, disclosures, warranties, or consumer rights that cannot legally be excluded.
SECTION 20 – ASSIGNMENT
You may not transfer your rights or obligations under these Terms without our prior written consent, except where applicable law permits otherwise.
We may transfer our rights and obligations as part of a merger, restructuring, sale of the business, or transfer of the Services, subject to applicable law.
A transfer will not reduce any mandatory consumer right.
SECTION 21 – GOVERNING LAW
These Terms and any separate agreements through which we provide the Services are governed by the laws of the Province of Quebec and the federal laws of Canada applicable in Quebec.
Nothing in this section deprives a consumer of any mandatory protection, remedy, or jurisdictional right available under the laws applicable in the consumer’s place of residence.

You may review the current version of these Terms on this page.
We may update these Terms to reflect changes to the Services, our practices, applicable laws, or operational requirements.
Material changes will be communicated where required by applicable law.
Changes will apply from the stated effective date and will not retroactively remove rights relating to an order already completed unless permitted by law.
